Professional (Partner) Terms

Read this if you offer services on XpertWorker. These terms govern your use of the Platform as an independent professional. They are in addition to our general Terms of Service. By registering as a professional, you accept them in full.

1. You Are Independent — We Only Connect You

YOU ARE AN INDEPENDENT, SELF-EMPLOYED SERVICE PROVIDER. NOTHING IN THESE TERMS CREATES ANY EMPLOYMENT, AGENCY, PARTNERSHIP, JOINT VENTURE, OR FRANCHISE RELATIONSHIP BETWEEN YOU AND XPERTWORKER TECHNOLOGIES.

XPERTWORKER DOES NOT OWN OR CONTROL YOUR BUSINESS, DOES NOT DIRECT OR SUPERVISE YOUR WORK, AND DOES NOT GUARANTEE YOU ANY MINIMUM LEADS, JOBS, OR INCOME. YOU DECIDE WHICH JOBS TO ACCEPT, HOW TO PERFORM THEM, AND WHAT TO CHARGE. WE SIMPLY CONNECT YOU WITH CUSTOMERS NEAR YOU.

2. Registration & KYC

To list on the Platform you must complete OTP-verified registration and submit government identity documents (such as PAN and Aadhaar) for KYC. This KYC is a document-matching check only — it is not a skills, licence, or background verification, and you must not represent it to customers as an XpertWorker endorsement of your abilities. You must keep your profile accurate and up to date.

3. Leads & Lead Fees

When a customer's booking request in your area and category is shared with you, that is a "Lead". You may be charged a Lead Fee (in wallet credits) when a Lead is delivered to you.

LEAD FEES ARE FOR THE INTRODUCTION ONLY AND ARE NON-REFUNDABLE ONCE A LEAD HAS BEEN DELIVERED — WHETHER OR NOT THE CUSTOMER ENGAGES YOU, AWARDS THE JOB TO SOMEONE ELSE, OR CANCELS.

Limited good-faith lead-credit reviews (for duplicate leads, verified technical errors, or wrong-category dispatch) are described in our Refund & Cancellation Policy and are granted at our discretion.

4. Wallet & Credits

You pre-load wallet credits to receive Leads. Credits have no cash value except as expressly stated, are non-transferable, and are non-refundable except where we terminate your account for reasons not attributable to your breach, or where the law requires a refund. We may vary Lead Fees and plan pricing on reasonable notice.

5. Pricing — You Set It, Not Us

You alone set and quote the price for your services, based on the actual work. Any prices shown on the Platform are indicative estimates only. XpertWorker never charges the customer and takes no commission on the job — the customer pays you directly on completion.

6. Your Obligations

You represent, warrant, and undertake that you will:

  1. Hold and maintain all licences, permits, and registrations required by law for your trade;
  2. Perform every job competently, safely, lawfully, and to a professional standard;
  3. Carry your own tools, materials, and any insurance you consider appropriate;
  4. Treat customers, their homes, and their belongings with honesty and care;
  5. Comply with all applicable laws, safety regulations, and codes of conduct;
  6. Be solely and exclusively responsible for the quality, safety, and outcome of your work.

7. No Off-Platform Solicitation or Misuse of Data

Customer contact details are shared with you solely to service the specific Lead. You must not use them for unsolicited marketing, sell or share them, or divert customers off-platform to avoid Lead Fees. Breach may result in immediate termination and recovery of losses.

8. Ratings, Reviews & Conduct

Customers may rate and review you. You must not post, buy, or coerce fake reviews, or retaliate against customers for honest feedback. You must follow our Acceptable Use Policy at all times.

9. Taxes

You are solely responsible for your own taxes, including income tax and any GST applicable to your services, and for issuing any invoices the law requires you to give customers. XpertWorker is not responsible for your tax compliance.

10. Suspension & Termination

We may suspend or terminate your access at any time, with or without notice, for breach of these terms, customer-safety concerns, fraud, repeated poor ratings, or any lawful reason. You may stop using the Platform at any time; accrued Lead Fees remain non-refundable.

11. Liability & Indemnity

XPERTWORKER'S TOTAL LIABILITY TO YOU IN ANY MATTER SHALL NOT EXCEED THE LEAD FEES YOU ACTUALLY PAID US IN THE THREE (3) MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR LOST PROFITS, LOST OPPORTUNITY, OR ANY INDIRECT OR CONSEQUENTIAL LOSS.

YOU AGREE TO INDEMNIFY AND HOLD XPERTWORKER HARMLESS AGAINST ALL CLAIMS, LOSSES, DAMAGES, AND COSTS ARISING FROM YOUR SERVICES, YOUR BREACH OF THESE TERMS, YOUR BREACH OF ANY LAW, OR ANY DISPUTE BETWEEN YOU AND A CUSTOMER.

12. Governing Law & Grievances

These terms are governed by the laws of India, with the courts and arbitration seat at New Delhi (as set out in our Terms of Service). To raise a complaint, contact support@xpertworker.com or use our Grievance Redressal page.
